The current Louisiana legal system differs from the legal systems of the other states in the United States. The major difference between its legal system and the rest of the states’ legal systems is that Louisiana is a civil law state while other states in the US are common law states. French history greatly contributes towards the development of the current legal system in Louisiana. This jury system has secrecy of proceedings whereby the investigations are carried out in secrecy to protect the name of the convicted. A statement that the person is under investigation may tint his name, so this policy is there to protect the person’s reputation in the community.

Under the system of the civil law like the one in Louisiana, the overt things written on the statutes of the states are the ones a person can be sued for. The state allows a split-jury to decide on the criminal case. There are two types of juries in this system. There is the jury of accusation and the jury of conviction. The role of the jury of accusation is to determine whether the evidence presented is enough for conviction or not. The role of the jury of conviction is to determine whether the convicted person is guilty or innocent.

A unanimous verdict should not be required since the legal system judges someone based on the statutes of the states. If a person is found guilty according to the statutes, he should be punished based on the crime he has committed. If a person has committed a crime which the statutes do not articulately affirm as a crime, he is deemed to be innocent since the state is led by civil law.
